Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Biosca Inc, a Florida corporation operating as Parker Home Care ("Parker," "we," "us," or "our"). By accessing or using the Parker Home Care website, mobile application, or any services provided by Parker (collectively, the "Services"), you agree to be bound by these Terms.
Parker Home Care is operated by Biosca Inc, a Florida-licensed general contractor (Florida GC License #CGC1528910). All services, contracts, and obligations referenced herein are those of Biosca Inc.
If you do not agree to these Terms, you may not access or use the Services. We reserve the right to modify these Terms at any time. Continued use of the Services after any modification constitutes acceptance of the revised Terms.
2. Description of Services
Parker Home Care is a managed home services company that coordinates licensed, insured professionals to perform home maintenance, repair, and improvement work on behalf of homeowners in Port St. Lucie and Palm City, Florida. Parker is not a referral platform, marketplace, or lead generator.
Our Services include, but are not limited to:
- Fixed-price home repair and maintenance services (Tier 1 catalog services)
- Estimator site visits and custom project proposals (Tier 2 services)
- General contracting and renovation project management (Tier 3 services)
- Quarterly home inspection and maintenance membership programs
- Documentation, reporting, and home maintenance records
Parker manages the entire customer experience from request to completion. All pricing, scheduling, scope of work, and communication between customers and service professionals are coordinated exclusively through Parker.
3. Account Registration and Eligibility
To use certain features of the Services, you must create an account by signing in with Google or Apple. By creating an account, you represent that:
- You are at least 18 years of age
- You are the legal owner or authorized agent of the property for which you are requesting services
- All information you provide is accurate and complete
- You will maintain the security of your account credentials
You are responsible for all activity that occurs under your account. You agree to notify Parker immediately of any unauthorized use of your account.
4. Service Pricing and Payment
4.1 Fixed-Price Services
Tier 1 services are offered at fixed, pre-determined prices as displayed in our Service Catalog. Prices include labor and, where indicated, materials. The price shown at the time of booking confirmation is the price you will be charged, subject to any applicable member discounts.
4.2 Estimated Services
Tier 2 and Tier 3 services require a site visit by a Parker estimator before pricing can be determined. A non-refundable site visit fee may apply and will be clearly disclosed before you authorize the visit. If you proceed with the proposed work, the site visit fee will be credited toward your final invoice.
4.3 Payment Terms
Payment is collected through our secure payment processing partner, Stripe. By submitting payment information, you authorize Parker to charge the agreed-upon amount upon completion of services unless otherwise specified. All prices are quoted in U.S. dollars.
4.4 Member Pricing
Active Parker Members receive member pricing on Parker-performed services according to their membership tier, as stated in their Membership Agreement and displayed alongside catalog prices. Member pricing is automatically applied when you are logged in with an active membership. Member discounts cannot be combined with other promotional offers unless expressly stated.
5. Membership Program
Parker offers a membership program in three tiers, each including inspection, preventative maintenance, and documentation benefits recorded in the Parker Home Record. Membership terms, pricing, and benefits are detailed in the separate Membership Agreement provided at the time of enrollment.
Each membership is a twelve (12) month agreement at the tier's annual rate. The membership year may be paid in full at enrollment (at a reduced paid-in-full price), or in quarterly or monthly installments. All membership payments are collected automatically from the payment method on file; Parker does not issue invoices for scheduled membership payments, and a receipt is provided for each automatic charge.
Membership renews automatically for successive twelve (12) month terms unless canceled before the renewal date. Canceling does not shorten the current membership year or reduce the amount owed for it: benefits continue through the end of the membership year, and if you pay by installment, the remaining installments for the year continue to be charged (or the remaining balance may be charged in a single payment). Cancellation prevents renewal into a new term; it does not relieve payment of the current term, except as required by applicable law.
6. Service Professionals and Contractor Relationships
Work arranged through Parker is performed by Parker's field team: Parker Home Specialists, who are employees of Biosca Inc performing work within the scope permitted by Florida law, and independent, licensed, and insured specialty contractors ("Service Professionals") engaged for work requiring a trade license or permit. All field personnel are vetted through Parker's onboarding process, including background checks and, for Service Professionals, license and insurance verification and execution of an independent contractor agreement.
Service Professionals are independent businesses, not employees of Parker or Biosca Inc, and are the contractor of record for licensed trade work they perform, including pulling their own permits where required. Parker coordinates, manages, and stands behind the quality of the work performed.
6.1 No Direct Contact
All communication between customers and Service Professionals is routed through Parker. Service Professionals are contractually prohibited from soliciting direct business with Parker customers. Customers agree not to engage Parker-introduced Service Professionals for work outside the Parker platform for a period of 24 months following the last service date.
6.2 Scope Changes
Any changes to the agreed scope of work must be approved by Parker before additional work begins. Service Professionals are not authorized to modify pricing, scope, or scheduling without Parker's written approval. If additional work is identified during a service visit, the Service Professional will report findings to Parker, and Parker will present a revised proposal for your approval.
7. Cancellation and Rescheduling
In accordance with the Florida Home Solicitation Sales Act (Florida Statutes §§ 501.021–501.055), where it applies you may cancel any service contract within three (3) business days of signing for a full refund, provided that work has not yet commenced.
Beyond the cooling-off period:
- More than 24 hours before scheduled service: Full refund or reschedule at no charge.
- Less than 24 hours before scheduled service: A cancellation fee of up to 15% of the service price may apply to cover scheduling and dispatch costs.
- After work has commenced: You are responsible for payment of all work completed to date, plus any materials already procured.
Parker reserves the right to cancel or reschedule services due to weather, safety concerns, Service Professional availability, or other circumstances beyond our control. In such cases, you will be notified promptly and offered a rescheduled date at no additional cost.
8. Warranties and Quality Guarantee
Parker stands behind the quality of all work coordinated through our platform. We provide a 30-day workmanship guarantee on all completed services. If you experience an issue with work performed through Parker within 30 days of completion, contact us and we will arrange for the issue to be corrected at no additional charge.
This guarantee covers defects in workmanship only. It does not cover:
- Normal wear and tear
- Damage caused by the customer, third parties, or acts of nature
- Pre-existing conditions not identified in the original scope of work
- Customer-supplied materials or equipment
Manufacturer warranties on materials and equipment are passed through to the customer and are subject to the manufacturer's terms.
9. Permits and Licensing
Certain work may require permits from local building authorities in accordance with Florida law and the Florida Building Code. Where permits are required, Parker will advise you of the requirement and any associated permit fees before work begins. Permit fees are the responsibility of the customer and are not included in service pricing unless expressly stated.
Parker Home Care operates under Biosca Inc, which holds Florida General Contractor License #CGC1528910. Licensed sub-contractors or GC partners engaged by Parker pull their own permits as required by Florida Statutes § 489.126.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARKER'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO PARKER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL PARKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR DAMAGE TO PROPERTY NOT DIRECTLY RESULTING FROM PARKER-COORDINATED WORK, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.
Nothing in these Terms shall exclude or limit liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable Florida law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Parker, Biosca Inc, and their respective officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any inaccurate or incomplete information you provide to Parker.
12. Dispute Resolution
12.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact Parker at hello@parker-care.com to attempt to resolve the dispute informally. Parker will make commercially reasonable efforts to resolve any complaint within fifteen (15) business days.
12.2 Mediation
If an informal resolution is not reached, either party may initiate non-binding mediation administered by a mutually agreed-upon mediator in St. Lucie County, Florida. The costs of mediation shall be shared equally between the parties.
12.3 Binding Arbitration
Any dispute not resolved through mediation shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in St. Lucie County, Florida. The arbitrator's decision shall be final and binding.
12.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Parker.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in St. Lucie County, Florida.
14. Intellectual Property
The Parker name, logo, wordmark, and all content on the Parker website and portal — including text, graphics, images, software, and design elements — are the property of Biosca Inc and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
By uploading photos or content through the Parker portal, you grant Parker a non-exclusive, royalty-free license to use such content for the purpose of providing the Services, including sharing with Service Professionals, generating reports, and internal quality review.
15. Property Access and Customer Responsibilities
By scheduling a service, you grant Parker and its authorized Service Professionals permission to access the designated property at the agreed-upon date and time. You are responsible for:
- Ensuring safe and clear access to the work area
- Securing pets and valuables before the service visit
- Providing accurate property information including gate codes, parking instructions, and access details
- Disclosing any known hazards, such as asbestos, mold, or structural concerns
15.1 Property Photography and Documentation
Parker documents the work it performs and the condition of the systems it inspects. By scheduling a walkthrough, inspection, or service, you grant Parker and its authorized field personnel permission to photograph and take video of the interior and exterior of the property during the visit. This documentation is used to build and maintain the Parker Home Record for the property, prepare inspection reports and estimates, verify completed work, and support quality assurance, and is retained as part of the property's record. You may designate specific areas of the home as excluded from photography by written notice to hello@parker-care.com; Parker will honor the designation except where documentation is reasonably necessary to record a safety condition or completed work.
15.2 Inspection Information and Sharing
You grant Parker permission to collect, retain, and use the information gathered through inspections, visits, and service work, including findings, condition ratings, photographs, measurements, system and equipment details, and maintenance history. You authorize Parker to share this information with third parties, including: (a) Parker's field personnel and licensed contractor partners as needed to price, perform, or verify work; (b) parties you direct Parker to share it with, such as insurers, real estate agents, prospective buyers, or lenders; (c) Parker's service providers that host and process data on Parker's behalf; and (d) other third parties in connection with Parker's business, including in de-identified or aggregated form that does not identify you. Parker's handling of personal information is further described in our Privacy Policy.
16. Communications
By creating an account, you consent to receive electronic communications from Parker, including service confirmations, estimates, invoices, appointment reminders, and marketing communications. You may opt out of marketing communications at any time. Transactional communications related to active services cannot be opted out of.
17. Termination
Parker may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abusive behavior toward Service Professionals, or failure to pay for completed services. You may close your account at any time by contacting us at hello@parker-care.com. Account termination does not relieve you of any obligations to pay for services already rendered.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Membership Agreement, constitute the entire agreement between you and Parker regarding your use of the Services. These Terms supersede any prior agreements or understandings, whether written or oral.
